Direct insurance

For mandatory cover, the Consorcio must indemnify the affected party for the amount of the damage suffered, up to the legally established limit Pdf file. Open in a new window (70 million euros per loss regardless of the number of victims for damage to persons and 15 million euros per loss for damage to property). In order to demand compliance on the part of the Consorcio, the affected party or his/her heirs may exercise direct action, which prescribes after a period of one year.

In the case of voluntary cover that exceeds the limits of the mandatory insurance, the indemnity will reach a maximum of 50 million euros per loss (personal and material damage together) for cases involving private vehicles. In the case of official vehicles insured by the Consorcio, this voluntary cover is unlimited.

Subsidiary cover

The Consorcio must indemnify the affected parties within the territorial scope and up to the quantitative limit of the mandatory insurance Pdf file. Open in a new window ,with the affected party also having the option to take direct action against the Consorcio on which, on the other hand, it cannot make payment of the indemnity conditional on said party's proof that the person responsible cannot pay or refuses to do so.

Provision of healthcare assistance

Apart from the previously mentioned indemnities, the Consorcio will assume all of the costs of necessary healthcare assistance (medical, pharmaceutical, hospital care) until the healing of all the consequences and after-effects of the injuries. These expenses will be duly justified in line with the nature of the healthcare provided.

Burial and funeral expenses

In the event of death, the Consorcio will also assume burial and funeral expenses in the amount that is duly justified in accordance with the uses and customs of the place in which said services were provided.

Rights of recourse

The Consorcio exercises these rights in the same way as is contemplated for the remainder of insurance entities to exercise this right, which is according to article 10 of the Third Party Motor Liability Law. The Consorcio may also seek recourse against the owner and person responsible for an accident in the case of an uninsured vehicle, or against the perpetrators and accomplices of those who steal or illegitimately use a vehicle that causes an accident, as well as the person responsible for the accident who is aware that the vehicle was stolen or being used illegitimately. In exercising this right of recourse, the enforcement order will be the President of the Consorcio de Compensaciones' certificate accrediting the amount of the indemnity paid out by the Consorcio, always assuming that the responsible party, upon being required to effect the payment, has not effected same within a period of one month from the date of said requirement.
